Answer
Article 21(5) of the Education and Libraries (Northern Ireland) Order 1986 provides that where a parent requests that a pupil be wholly or partly excused from attendance at religious education, collective worship, or both, the pupil shall be excused in accordance with that request until it is withdrawn.
The legislation does not specify how schools should proceed where one parent requests withdrawal and another parent objects.
In such circumstances, schools are expected to consider the particular circumstances of the case, taking account of their legal obligations and any relevant parental rights and responsibilities. Where necessary, schools may seek their own legal advice.
